TO INSTITUTE
PROCEEDINGS TO ENTER INTO A LOAN AGREEMENT
IN A PRINCIPAL AMOUNT NOT TO EXCEED $750,000
The Board of Supervisors of Benton County, Iowa, will meet on the 30th day of March, 2010, at the Boardroom, Benton County Courthouse, Vinton, Iowa, at 10:30 o’clock a.m., for the purpose of instituting proceedings and taking action to enter into a loan agreement (the “Loan Agreement”) in a principal amount not to exceed $750,000 for the purpose of financing a portion of the cost of constructing and equipping a new County Law Enforcement Center.
The Loan Agreement is proposed to be entered into pursuant to authority contained in Section 331.402 of the Code of Iowa. The Loan Agreement will constitute a general obligation of the County.
At that time and place, oral or written objections may be filed or made to the proposal to enter into the Loan Agreement. After receiving objections, the County may determine to enter into the Loan Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.

Notice is hereby given that a Public Hearing will be conducted by the Board of Supervisors, Benton County, Iowa in accordance with Section 26.12 of the 2009 Code of Iowa, at the date, time and location as specified below. THIS NOTICE IS A REVISION TO THE NOTICE TO BIDDERS PUBLISHED ON OR ABOUT MARCH 3, 2010 IN THE VINTON EAGLE, THE CEDAR VALLEY TIMES, AND THE STAR PRESS UNION. THE PURPOSE OF THIS REVISED NOTICE IS TO CHANGE THE DATE THAT BIDS WILL BE ACCEPTED AND THE DATE THAT BIDS WILL BE OPENED. ALL OTHER PARTS OF THE ORIGINAL PUBLISHED NOTICE TO BIDDERS REMAINS IN FULL FORCE AND EFFECT.

The Board of Supervisors will hold a public hearing on this public project at 9:30 a.m. March 30, 2010 and, during the public hearing, will vote to approve or not approve the proposed plans, specifications, form of contract, and estimated cost of construction for this project.
All bid proposals submitted by the time and date stated above will be publicly opened and read by the Benton County Auditor or her authorized representative at their office at 111 East 4th Street, Vinton, Iowa at 3:15 p.m. on March 24th, 2010. The Board of Supervisors has delegated this bid opening authority to the Benton County Auditor in accordance with Chapter 26, Code of Iowa. Benton County Auditor will report the results of the bidding and the architect will make their recommendation at the next Benton County Board of Supervisors meeting scheduled for Tuesday, March 30, 2010, at 9:45 a.m.
This public improvement consists of work to construct The Benton County Law Enforcement Building and site improvements at 113 E. 3rd St., Vinton, Iowa.

Work associated with this project may commence anytime prior to May 1, 2010 and shall be completed by April 29, 2011. Contractor is to start work within 5 days of Notice to Proceed or from date project agreement is signed, whichever is sooner. Project will have liquidated damages of $250 per calendar day.
A mandatory on-site pre-bid meeting will be held on Wednesday March, 10, 2010 at 1:30 p.m. Contractors or a designated representative are required to attend.
Construction documents will be issued to Contractors upon deposit of $250.00 per set. Deposits will only be accepted as checks made out to the BENTON COUNTY AUDITOR. Other forms of deposits such as a MBI card WILL NOT be accepted. Deposits will be refunded upon return of Plans and Specifications in good condition to the printer – Technigraphics within ten (10) days after bid opening. Deposit checks remaining after April 12, 2010 WILL be cashed by the Benton County Auditor.
Partial sets of the construction documents will not be available from the printer.

All addenda issued during the bidding period are to be covered in the bid and in closing a contract they are to become a part thereof.
Each proposal shall be made on the Bid proposal Form prepared for this purpose. Any alteration in the official Bid Proposal Form will entitle the County, at its option, to reject the proposals involved from consideration.
Bidding periods are to be covered in the bid, and in closing of an agreement they are to become a part thereof.
By making a bid proposal on this Project, the bidder represents that the bidder has examined the construction documents. Any questions about the meaning or intent of the plans, specifications and/or project manual must be submitted on or before March 17, 2010. The last day an addendum may be issued is before noon on March 22, 2010.
All work is to be done in strict compliance with these plans and specifications.
Bid proposals shall be completed in the format of the bid proposal sheet included in the project manual. Other documents that are a part of the project manual include:

The bidder who is awarded the contract shall execute a Letter of Agreement and will be given a Notice to Proceed at the direction of the County.
Bids shall be made as a lump sum for the entire work. It is intended that a contract be awarded to the lowest responsive, responsible bidder. Benton County and its Board of Supervisors reserves the right to reject any or all bids, to waive minor informalities in any bid or to make award in the best interest of the County. The Benton County Board of Supervisors reserves the right to defer acceptance of any proposal for a period not to exceed thirty (30) calendar days from the date of receiving bids.

Performance Bond – The successful bidder shall be required to provide a performance bond in the amount of one hundred percent (100%) of the contract price.
An original and a copy of the bid proposal shall be enclosed in an envelope marked “Proposal” and bearing the title of the work and the name of the bidder.
This project is being funded wholly or in part with Benton County, Iowa, funds and to which Benton County, Iowa, is signatory; the successful bidders must comply with all Benton County regulations, City of Vinton, Iowa regulations, Safety and OSHA regulations and Affirmative Action Programs.
Iowa Preference: By virtue of statutory authority, a preference will be given to products and provisions grown and coal produced within the state of Iowa and to Iowa domestic labor.
This project is being funded wholly or in part by the Federal Emergency Management Agency (FEMA) through the grantee (State of Iowa), the successful bidders must comply with all FEMA regulations and requirements.
